DOMOMENT TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

Welcome to domoment! These Terms of Service ("Terms") are a legal agreement between you and domoment.

By accessing or using the domoment mobile application and related services (the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you don't agree, don't use the Service.

If you're using domoment on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. ELIGIBILITY

You must:

• Be at least 13 years old (or 16 in the EU)
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable law

If you're under 18, you must have parental consent to use the Service.

3. ACCOUNT REGISTRATION

3.1 Creating an Account

To use domoment, you must:

• Provide accurate, current information (email, name)
• Keep your password secure and confidential
• Notify us immediately of unauthorized access

You're responsible for all activity under your account.

3.2 Account Security

• Don't share your account credentials with anyone
• Use a strong, unique password
• Enable two-factor authentication when available

We're not liable for losses from unauthorized account access if you failed to protect your credentials.

3.3 Account Termination

You can delete your account anytime in Settings. We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or harm other users
• Don't pay subscription fees

If we terminate your account, you'll get 7 days to export your data.

4. YOUR CONTENT & INTELLECTUAL PROPERTY

4.1 Ownership

You own all content you create in domoment:

• Voice recordings
• Text notes and transcripts
• AI-generated summaries and outlines (created from your input)
• Tasks, tags, and organizational structure

We don't claim ownership of your content.

4.2 License to Us

By using the Service, you grant us a limited license to:

• Store your content on our servers
• Process your content to provide features (transcription, AI summaries)
• Display your content back to you across your devices
• Make backups to prevent data loss
• Use anonymized, aggregated data to improve the Service

This license ends when you delete content or close your account.

4.3 AI-Generated Content

• Output Ownership: You own AI-generated summaries, outlines, and suggestions created from your input.
• Accuracy: AI may produce inaccurate or incomplete results. You're responsible for reviewing and verifying AI-generated content.
• No Warranty: We don't guarantee AI accuracy, suitability, or completeness.
• Similar Outputs: AI may generate similar content for different users based on similar inputs. This doesn't violate your ownership rights.

4.4 Our Intellectual Property

domoment's technology, design, code, and trademarks are our property (or our licensors'). You can't:

• Copy, modify, or reverse-engineer our code
• Use our trademarks without permission
• Scrape or extract data from the Service
• Create derivative works

5. ACCEPTABLE USE

5.1 You May

• Use domoment for personal or business productivity
• Capture and organize ideas, notes, and tasks
• Share your content with others (your choice)
• Export your data anytime

5.2 You May NOT

• Violate any laws or regulations
• Infringe on others' intellectual property
• Upload illegal, harmful, or offensive content
• Use the Service to harass, threaten, or harm others
• Attempt to hack, breach, or disrupt the Service
• Use the Service for unauthorized commercial purposes (e.g., reselling)
• Upload viruses, malware, or malicious code
• Impersonate others or create fake accounts
• Abuse AI features (e.g., generating spam content)
• Exceed rate limits or abuse API access

5.3 Content Moderation

We don't actively monitor your private content. However, we may:

• Review content if we receive a legal request or abuse report
• Remove content that violates these Terms
• Suspend accounts engaged in illegal activity

We're not responsible for user-generated content.

6. SUBSCRIPTIONS & PAYMENTS

6.1 Free Tier

domoment offers a free tier with limited features. Free accounts include:

• Unlimited notes per month
• 10 minutes of voice transcription per month
• Basic features

6.2 Paid Subscriptions

Paid plans unlock:

• Unlimited notes and voice transcription
• Advanced AI features
• Priority support
• Unlimited storage

Pricing: $7.99/month

6.3 Billing

• Auto-Renewal: Subscriptions renew automatically unless cancelled
• Payment: Charged to your Apple App Store or Google Play account
• Price Changes: We'll notify you 30 days before price increases
• Taxes: Prices exclude applicable taxes (added at checkout)

6.4 Cancellation & Refunds

• Cancel Anytime: In Settings → Subscriptions or via App Store/Play Store
• Effect: Access to paid features continues until end of billing period
• Refunds: Generally no refunds, but contact support@domoment.com if you have issues. Apple/Google handle App Store refunds per their policies.

6.5 Free Trials

• Promotional free trials may be offered
• You must cancel before trial ends to avoid charges
• One trial per user

7. THIRD-PARTY SERVICES

domoment integrates with third-party services:

• OpenAI: Voice transcription and AI processing
• Apple iCloud: Data sync (if you enable)
• [Other integrations]: Export to Notion, Google Docs, etc.

Your use of these services is subject to their own terms and privacy policies. We're not responsible for third-party services.

8. DATA & PRIVACY

Your data is handled per our Privacy Policy (https://domoment.com/privacy).

Key points:

• We encrypt data in transit and at rest
• We don't sell your data
• You can export or delete data anytime
• We use OpenAI to process voice and text (your data isn't used to train their public models)

9. DISCLAIMERS & LIMITATIONS OF LIABILITY

9.1 Service "As Is"

domoment is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including:

• Fitness for a particular purpose
• Accuracy or reliability
• Uninterrupted or error-free service
• Security or data loss prevention

9.2 AI Accuracy

AI-generated content may contain errors, inaccuracies, or biases. You're solely responsible for:

• Reviewing AI suggestions before use
• Verifying information for accuracy
• Any decisions made based on AI-generated content

We're not liable for damages arising from reliance on AI outputs.

9.3 Data Loss

While we take backups seriously, we're not liable for:

• Data loss due to user error (e.g., accidental deletion)
• Service outages or technical failures
• Third-party service failures (OpenAI, cloud providers)

Recommendation: Keep local backups of critical content.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability is limited to the amount you paid us in the past 12 months (or $100 if you're on a free plan)
• We're not liable for indirect, incidental, consequential, or punitive damages
• This includes lost profits, data loss, or business interruption

Some jurisdictions don't allow these limitations, so they may not apply to you.

9.5 Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your violation of others' rights

10. DISPUTE RESOLUTION

10.1 Informal Resolution

Before filing a claim, contact us at info@domoment.com to resolve the issue informally. We'll try to resolve disputes within 30 days.

10.2 Arbitration Agreement (US Users)

If informal resolution fails, disputes will be resolved through binding arbitration, NOT in court (except small claims court).

• Arbitration: Administered by American Arbitration Association (AAA)
• Rules: AAA Consumer Arbitration Rules
• Location: [Your city/state] or remotely (your choice)
• Fees: We'll pay arbitration fees for claims under $10,000
• No Class Actions: You can't join a class action or class arbitration

You have the right to opt out of arbitration within 30 days of agreeing to these Terms by emailing info@domoment.com.

10.3 EU Users

EU users may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

10.4 Governing Law

• US Users: Governed by laws of [Your State], USA, excluding conflicts of law
• EU Users: Governed by laws of your country of residence

11. CHANGES TO TERMS

We may update these Terms as we add features or comply with regulations. We'll notify you of material changes via:

• Notice on our website

If you continue using the Service after changes, you accept the new Terms.

12. TERMINATION

12.1 By You

You can stop using domoment and delete your account anytime.

12.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You don't pay subscription fees
• We discontinue the Service (we'll give 30 days' notice)

Upon termination:

• Your access ends immediately
• You have 7 days to export your data
• We'll delete your data per our Privacy Policy

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and domoment.

13.2 Severability

If any provision is found unenforceable, the rest of these Terms remain in effect.

13.3 No Waiver

Our failure to enforce a right doesn't waive that right.

13.4 Assignment

You can't transfer your rights under these Terms. We may assign our rights to a successor (e.g., if acquired).

13.5 Force Majeure

We're not liable for delays or failures due to events beyond our control (natural disasters, wars, pandemics, internet outages, etc.).
